REPORTING OF RETIREMENT INCOME FROM A PRIVATE SOURCE

SUMMARY:

 

Paragraph (a) of s. 112.3145(1), F. S., as amended by Ch. 74-177, Laws of Florida, excludes from disclosure retirement compensation from any level of government service. However, retirement income from a private or corporation source is not excluded and should therefore be disclosed on CE Form 1.

 

QUESTION:

 

Is retirement or pension income from a private or corporation source to be excluded from the financial disclosure statement, CE Form 1?

 

Your question is answered in the negative.

Paragraph (a) of s. 112.3145(1), F. S., excludes from disclosure "retirement or disability compensation and other compensation derived from any level of government service . . . ." It is our opinion that the words "retirement or disability compensation" refer exclusively to such compensation derived from a government source. Accordingly, retirement income from a private source or a corporation source is not excluded from the disclosure requirements of CE Form 1.
